Party Wall basement cost advice

Practical construction input for Party Wall cost questions

Darren helps owners and appointed Party Wall surveyors understand the basement work behind a cost question. Where a separate statutory appointment is required, specialist Party Wall surveyors for basement works in London can manage the Party Wall process. This may involve Section 11(11) or Section 12 of the Party Wall etc. Act 1996. He explains the work, sequence, quantities and assumptions. He does not act as the Party Wall surveyor, quantity surveyor or legal adviser.

A supporting role

Give the appointed surveyor clear construction facts.

The Party Wall etc. Act 1996 applies in England and Wales. It covers certain work to party structures, building at a boundary and excavation near neighbouring buildings. For projects involving foundations or basement excavation, a Party Wall survey for excavations and foundations may form part of the separate statutory process.

The appointed surveyor manages the process and any award under the Act. Darren explains the physical work, construction sequence, access and temporary support behind the cost question. This helps the surveyor test whether the quantities and assumptions are realistic.

Section 11(11)

When a neighbour later uses earlier work.

Section 11(11) can apply when an adjoining owner later uses work that the building owner paid for on their own.

The Act refers to a due share of the expense, based on what the work would cost at the time of later use. It does not say the adjoining owner must always pay half. The appointed surveyors must apply the Act to the particular circumstances.

Darren can describe the physical work, sequence, quantities and assumptions for the appointed surveyor to consider. He does not decide liability or provide a formal valuation.

Read Section 11 of the Act
Section 12

Security for expenses before work starts.

Section 12 allows an adjoining owner to ask for security before certain work starts. The owners may agree the security. If they dispute it, the matter is dealt with under Section 10.

Darren can explain the work behind the case the appointed surveyor wants assessed. This may include higher-risk stages, access, temporary support and the quantities involved.

He does not decide whether security is required or set its amount. He also does not advise how money should be held or released.
